BALER, Aurora – Four Chinese who were charged in August last year with the manufacture and possession of 5.44 kilograms of “shabu” were acquitted last week by a Regional Trial Court (RTC) here for failure of the prosecution to establish the guilt of the quartet beyond reasonable doubt.

Ordered freed from detention on the basis of the decision of RTC Branch 66 Judge Armando Yanga were Sy Tho, Wang Tha Ti, Chin Na Chua and Chen Chien.

BALER, Aurora – Four Chinese who were charged in August last year with the manufacture and possession of 5.44 kilograms of “shabu” were acquitted last week by a Regional Trial Court (RTC) here for failure of the prosecution to establish the guilt of the quartet beyond reasonable doubt.

Ordered freed from detention on the basis of the decision of RTC Branch 66 Judge Armando Yanga were Sy Tho, Wang Tha Ti, Chin Na Chua and Chen Chien.

Records of the case showed that the four Chinese nationals were arrested in a raid conducted by the National Bureau of Investigation (NBI) on Aug. 30, 2006 at Barangay Butas-na-Bato, Dingalan, Aurora, in a suspected house being used in the manufacture of the banned methamphetamine hydrochloride or “shabu.”

The Chinese were charged with violation of Section 8 (manufacture of dangerous drugs)and Section 11 (possession of dangerous drugs) of Republic 9165, known as the Comprehensive Dangerous Drugs Act of 2002. The offense of possession of 50 grams or more of shabu carries with it the maximum penalty of death and a fine of R10-million.

However, the court excluded the 5.44 kilograms of shabu which it said was the object of an “illegal search.”

Yanga is credited with a 90 percent conviction rate on drug-related offenses.
